1. About these terms

These Terms and Conditions govern your use of the services provided by J & K Bradley Reporting Pty Ltd ATF Topcat Discretionary Services Trust (ABN 71 908 010 981), trading as Bradley Reporting, Captify.live, CalGen.AI and The Hansard Consultancy (collectively, "we", "us" or "the Company").

By engaging Bradley Reporting's services, purchasing a Shearwater Transcriber licence or using this websites, you agree to be bound by these terms. If you do not agree, please do not use Bradley Reporting's services.

These terms are governed by the laws of Queensland, Australia.


2. Court reporting & transcription services

2.1 Bookings and confirmation

All bookings for court reporting, CART captioning, court recording transcription and Hansard services are confirmed in writing via email. A booking is not confirmed until written confirmation is provided by us.

2.2 Cancellations

  • Cancellations made more than 48 hours before the scheduled service: no charge
  • Cancellations made 24–48 hours before: 50% of the estimated fee applies
  • Cancellations made less than 24 hours before, or no-shows: 100% of the estimated fee applies
  • Court adjournments on the day of a hearing are treated as short-notice cancellations at our discretion

2.3 Accuracy and limitations

Bradley Reporting takes all reasonable care to produce accurate transcripts. However, the accuracy of transcription is inherently dependent on audio quality, speaker clarity, background noise and technical factors outside our control. We do not guarantee verbatim accuracy in adverse audio conditions and will advise clients where audio quality may affect transcript quality.

2.4 Payment terms

Invoices are issued on completion of services. Payment is due within 14 days of invoice date unless otherwise agreed in writing. Late payment may attract interest at 10% per annum from the due date.


3. Shearwater Transcriber software licence

Shearwater Transcriber is licensed software, not sold. Purchase of a licence grants you the right to use the software in accordance with these terms. All intellectual property in the software remains owned by J & K Bradley Reporting Pty Ltd.

3.1 Licence grant

Subject to payment of the applicable annual licence fee, we grant you a non-exclusive, non-transferable licence to install and use Shearwater Transcriber on up to two (2) devices for your personal or internal business use during the licence term.

3.2 Permitted use

  • Use the software for transcription work on your own devices
  • Install on up to 2 seats per licence
  • Use offline for up to 30 days during a grace period if the licensing server is unreachable

3.3 Prohibited use

  • Redistribute, resell or sublicence the software to any third party
  • Reverse engineer, decompile or disassemble the software
  • Remove or circumvent licensing, activation or copy protection mechanisms
  • Use the software for any unlawful purpose

3.4 Licence term and renewal

Licences are annual subscriptions. Your licence will expire 12 months from the date of purchase unless renewed. We will attempt to notify you in advance of expiry, but renewal remains your responsibility.

3.5 Refund policy

Due to the nature of downloadable software, refunds are not offered after the licence has been activated. If you experience a technical issue preventing use of the software, please contact Bradley Reporting before requesting a refund and every effort is made to resolve the issue.

No refunds will be issued where the software has been activated and used, or where the request is made more than 7 days after purchase.

3.6 Updates and support

Active licence holders are entitled to all software updates released during their licence term. Support is provided via email on a best-efforts basis. We do not guarantee response times but endeavour to respond to all support requests within 2 business days.


4. Confidentiality

Bradley Reporting treats all client matter information, transcript content, hearing recordings and correspondence as strictly confidential. Bradley Reporting will not disclose this information to any third party without your explicit consent, except where required by law.

Shearwater Transcriber processes all audio locally on the user's device. Audio files are not transmitted to our servers.


5. Intellectual property

All intellectual property in the software, websites, training materials, template documents and service frameworks remains the property of J & K Bradley Reporting Pty Ltd ATF Topcat Discretionary Services Trust.

Transcript documents produced from your audio files are your property upon full payment of our fees.


6. Limitation of liability

To the maximum extent permitted by applicable law, our total liability for any claim arising from Bradley Reporting's services or software is limited to the fees paid by you for the specific service or licence giving rise to the claim in the 12-month period preceding the claim.

Bradley Reporting is not liable for indirect, consequential, incidental or special damages, including loss of profit, loss of data or loss of opportunity, arising from your use of Bradley Reporting's services or software.

Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Australian consumer law.


7. Australian Consumer Law

Bradley Reporting's services and software come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service, you are entitled to cancel your service contract and receive a refund for the unused portion, or to compensation for the reduced value of the services provided. For major failures with goods (including software), you are entitled to a replacement or refund. You are also entitled to be compensated for any other reasonably foreseeable loss or damage.


8. Governing law

These Terms and Conditions are governed by the laws of Queensland, Australia. Any dispute arising from these terms will be subject to the exclusive jurisdiction of the courts of Queensland.


9. Changes to these terms

Bradley Reporting reserves the right to update these Terms and Conditions at any time. The current version will always be published on this page with the date of last update. Your continued use of Bradley Reporting's services after any update constitutes acceptance of the revised terms.
